Selling a Tenanted Property

A sale involving tenants needs a coordinated plan for the property, the campaign and the people living there. Establish the tenancy position before agreeing to a marketing timetable or promising vacant possession. A sale does not automatically end the tenancy.

Start with the tenancy and the intended sale

Give your lawyer the current tenancy agreement and discuss whether you intend to sell with the tenancy continuing or seek vacant possession. Involve the existing property manager where one is appointed. Work through the applicable process and dates before accepting sale terms that depend on the tenant leaving.

Tenancy Services explains selling a rental property, including different tenancy and possession scenarios. The landlord must notify tenants in writing when the property is put on the market. Ask for advice on the actual tenancy rather than assuming a notice period from a different situation applies.

Agree access and protect privacy

Discuss a workable arrangement for photography, viewings and professional visits. Tenants’ permission and reasonable conditions matter; routine inspection notice is not a blanket permission for open homes. Tenants can decline open homes and offer reasonable alternatives for viewings. Use the current access guidance when agreeing the arrangements.

Plan what will be photographed and how belongings and personal information will be protected. Record who communicates changes, how appointments are confirmed and how keys are managed. A clear calendar helps prevent avoidable disruption and conflicting instructions.

Give buyers accurate information

The campaign and agreement should be clear about the possession position. Do not advertise a guaranteed move-in date before the responsible advisers have established it. If the tenancy is continuing, agree which tenancy information can properly be provided and how buyer questions will be answered without unnecessary disclosure.

Property presentation must work within the access and privacy arrangements. Discuss the material that will help buyers understand the layout and condition without assuming the home can be staged or occupied differently during the campaign.

Coordinate the handover

If ownership changes with tenants remaining, plan the required tenant communication, payment instructions and bond-record steps with the responsible parties. Ask your lawyer and existing property manager who will complete each action. Ray White Devonport’s sales service should not be taken as a separate residential property-management appointment.

Read the selling guide and costs and agency-agreement guide, or request an appraisal. Tell the Devonport sales team there is a tenancy in place so the first conversation includes access, timing and the proposed possession terms.
